Poppy Seeds

Step 6 of 6 · Law

Are poppy seeds and opium poppies legal

Short answer

Poppy seeds are legal in the Netherlands, Germany, the United Kingdom and the United States: the drug laws of all four exclude the seed from their definitions. The plant and its other parts are a different matter. Opium, the capsules and dried plant material ("poppy straw") are controlled substances, and in Germany even growing the plant in a garden needs a permit. A few countries restrict the seeds themselves. All texts below were checked on 11 October 2026.

The line these laws draw

The Dutch, German, British and American texts follow the same split. The seed is food and falls outside the drug laws. Opium (the dried latex) and poppy straw (all parts of the plant except the seeds, after harvest) are controlled. That is why a bag of poppy seeds can be sold in a supermarket while dried poppy capsules can fall under the drug laws.

Food law covers the seed separately. In the EU, seed for consumers must stay below 20 mg/kg morphine equivalents (see EU limits).

Netherlands

The Dutch Opium Act (Opiumwet, text in force since 17 September 2026) lists on List I "opium: the coagulated latex obtained from the plant Papaver somniferum L." and "bolkaf: all parts of the plant Papaver somniferum L. after harvesting, with the exception of the seed", as well as concentrate of bolkaf. List I is the list of hard drugs. Poppy seeds are not on it and are sold as food. Dried poppy capsules are bolkaf. The text: wetten.overheid.nl.

The Opium Act does not mention the living ornamental plant separately, and we found no official guidance that settles the question for gardeners. We therefore make no statement about growing it in the Netherlands.

Germany

Annex III of the German Narcotics Act (BtMG Anlage III) lists Papaver somniferum, including the subspecies setigerum: plants and parts of plants, with the exception of the seeds. Dealing in the plant for ornamental purposes is exempt when its morphine content in dried form is no more than 0.02 percent, but that exemption explicitly does not cover cultivation.

Growing opium poppies, even a few in a private garden, therefore needs a permit from the Federal Opium Agency (Bundesopiumstelle) at the BfArM. Permits are issued for low-morphine varieties; the BfArM names the summer varieties 'Mieszko' and 'Viola' and the winter variety 'Zeno Morphex' as examples. Poppy seeds for baking are freely sold.

United Kingdom

Under Schedule 2 of the Misuse of Drugs Act 1971, opium and "poppy-straw and concentrate of poppy-straw" are Class A drugs. The Act defines poppy-straw as "all parts, except the seeds, of the opium poppy, after mowing", and the opium poppy as the plant of the species Papaver somniferum L. The seeds are excluded by that definition.

We did not find an official UK source that deals clearly with growing the plant in a garden, so we make no statement about it.

United States

The Controlled Substances Act defines the opium poppy as "the plant of the species Papaver somniferum L., except the seed thereof", and poppy straw as "all parts, except the seeds, of the opium poppy, after mowing" (21 U.S.C. 802). Both are listed in Schedule II. The Drug Enforcement Administration says that the seed is exempt but opium contamination on it is not, and the Justice Department has prosecuted sellers of unwashed seed, as reported by KFF Health News. There is no federal limit for morphine on food-grade seed (see EU limits).

Singapore

Singapore's Central Narcotics Bureau classifies poppy seeds as prohibited goods. Anyone who imports poppy seeds or food containing them, regardless of amount or purpose, must file an inward declaration with a certificate from the country of origin and have a sample tested by the Health Sciences Authority. The import is approved only if no controlled substances such as morphine are found (CNB).

Travelling with poppy seeds

Several other countries, mainly in the Gulf region and East Asia, are reported to restrict poppy seeds, including in food, but we could not confirm the rules from official sources. Before travelling with poppy seed products, check the customs authority of the destination country. Also keep in mind that a positive drug test abroad is judged under local rules.
